Abstract The term “special period” is used in several normative acts, while its definition in them is not the same. The only interpretation of the existence of a special period in the present day directly affects the social guarantees provided to certain persons, as well as the qualification of administrative and criminal offenses. In particular, the commission of a criminal offense in a special period is a qualifying feature of the majority of crimes against the established order of military service (section XIX of the Criminal Code of Ukraine. Therefore, the development of a unified approach to determining the starting point and completion in the state of a special period.
The purpose of the article is to create an author’s position regarding the meaning of the term “special period”.
The article substantiates the expediency of using the definition given in the Law of Ukraine “On Mobilization Preparation and Mobilization” of October 21, 1993. There are three conditions indicating the existence of a special period in the state: mobilization time, wartime and partly rebuild period after the end of hostilities. In addition, its components are defined: the period of functioning of the national economy, bodies of state authority, other state bodies, local self-government bodies, the Armed Forces of Ukraine, other military formations, civil defense forces, enterprises, institutions and organizations, as well as the fulfillment by Ukraine’s citizens of their constitutional duty on the protection of the Motherland, independence and territorial integrity of the state.
Arguments are made in favor of the fact that a special period in Ukraine is in force since the entry into force of the Decree of the Acting President of Ukraine of March 17, 2014, № 303/2014 “On Partial Mobilization”. It is noted that the wording “restoration period after the end of hostilities” in the legislation is not clearly defined and is estimated. Based on the analysis of the current legislation, the position is based on the fact that the special period in the state is not completed after the announcement of the decision of the President of Ukraine on demobilization, and after its complete execution.
